These Terms of Service (“Terms”) are an agreement between you and Tact (“Tact”, “we”, “us”) for the use of the Tact website, demo and application (the “Service”). By creating a workspace or using the Service, you agree to these Terms. If you use the Service for a company, you confirm you can bind that company to them.
1. The Service
Tact helps businesses manage comments and messages on their Facebook Pages and Instagram professional accounts. It can classify comments, draft and publish replies, hide comments, and send private replies, according to the settings you choose.
2. Your account
- You must be at least 18 and give accurate information.
- You are responsible for activity in your workspace and for keeping your login secure.
- You may connect only accounts that you own or are authorized to manage.
3. Your responsibilities
- Follow Meta’s Community Standards, Advertising Standards and platform terms, and all laws that apply to your business, including consumer-protection, advertising and privacy laws.
- Keep your product, price, shipping and policy information accurate. Replies are based on it.
- Review the automation settings, “never say” rules and review threshold, and check held comments regularly.
- Have a lawful basis, and give any notices required, for processing your commenters’ data through the Service.
4. AI-generated content
Replies and messages are generated automatically and can be wrong, incomplete or unsuitable. You are responsible for the content published from your accounts, including automated content. You can edit, approve or undo replies from the dashboard, and you can turn automation off at any time.
5. Acceptable use
You may not use the Service to:
- send spam, unsolicited bulk messages, or messages outside what Meta allows;
- make false, misleading, or unlawful claims, including medical or financial claims;
- harass, discriminate against, or deceive people;
- break, probe, overload, or reverse-engineer the Service, or get around its limits;
- process data you are not allowed to process.
6. Data and privacy
You keep ownership of your content and data. You give us permission to process it only to provide and improve the Service, as described in our Privacy Policy. For commenters’ personal data, we act as your service provider and process it on your instructions.
7. Third-party services
The Service depends on Meta’s platforms and APIs and on other providers. We are not responsible for their availability or changes. If Meta limits or revokes access, some features may stop working.
8. Fees
The Service is currently offered free of charge during early access. Before any paid plan applies to you, we will show the price and ask you to agree to it. You will never be charged without that agreement.
9. Intellectual property
We own the Service, including its software and design. We give you a limited, non-exclusive, non-transferable right to use it under these Terms. Feedback you send us may be used freely to improve the Service.
10. Suspension and termination
You can stop using the Service and delete your workspace at any time. We may suspend or end access if you break these Terms, if required by law or by Meta, or to protect the Service or other users. On termination, we delete your data as described in the Privacy Policy.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any number of sales, replies, or results.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100.
13. Indemnity
You will defend and indemnify us against claims arising from your content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Mandatory consumer protections where you live still apply.
15. Changes
We may update these Terms. We will post the new version here and, for significant changes, notify you in advance. Continuing to use the Service after a change takes effect means you accept it.
